1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website, online store, and related services provided by WANNADO.ROCKS (“we”, “us”, “our”).
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you must not use the Services.

2. Eligibility & Accounts

By using the Services, you represent that you are at least the age of majority in your country of residence.
You agree that any information provided is accurate and up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You may not transfer or assign your account without our written consent.

3. Products

We strive to display product images and details as accurately as possible. However, actual appearance may differ due to device screen settings or production tolerances.
All product descriptions, prices, availability and features may change without notice. We may limit or refuse orders at our discretion.

4. Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order.
An order is considered accepted only after payment has been processed and we issue an order confirmation.
Purchases must be for personal use and not for commercial resale without our written permission.

5. On-Demand Production, Cancellations & Return Rights

Many products offered through our store — including but not limited to limited-edition bundles, apparel, and trading cards — are produced on-demand and manufactured individually after the drop period ends.

By placing an order for on-demand items, you acknowledge and agree to the following:

5.1 No Right of Withdrawal / No Returns

Under EU consumer protection laws (Directive 2011/83/EU, Article 16(c)) and comparable international rules, the statutory right of withdrawal does not apply to goods that are custom-made, produced to order, or clearly personalized.
Therefore, orders may not be cancelled or returned once the drop period ends, except in cases of verified defects.

5.2 Changes & Cancellations

Requests to modify or cancel orders can only be considered before the drop period ends. Once production begins, all orders are final.

5.3 Defective Items

If a delivered product is defective or damaged, you may request repair, replacement, or refund in accordance with applicable consumer rights.
Claims must be submitted in writing within 7 days of delivery and include photographic evidence.
Minor production variances typical of handcrafted or limited-edition products are not considered defects.

5.4 International Customers

The above rules apply except where mandatory consumer rights law in your country requires otherwise.

6. Pricing & Payments

Prices displayed at checkout are final at the time of purchase, unless stated otherwise, and exclude shipping, customs, and taxes where applicable.
You agree to provide accurate billing details and authorize us to charge the payment method provided.

7. Shipping & Delivery

Shipping times are estimates and not guaranteed.
We are not responsible for delays caused by carriers, customs processes, strikes, or events beyond our control.
Risk of loss transfers to you once the package is handed to the carrier.

8. Intellectual Property

All content on the Services, including artwork, trading card designs, images, videos, text, structure and trademarks, is owned by WANNADO.ROCKS or its licensors and protected by intellectual property law.
You may not copy, distribute, modify, publish, or exploit any content without written consent.

9. Shopify & Third-Party Services

Our online store and checkout system are technically powered by Shopify.
All purchases are made directly with WANNADO.ROCKS as the seller of record. Shopify is not responsible for product quality, refunds, fulfillment, or claims.
Some personal data necessary to process orders may be shared with Shopify and handled under Shopify’s Privacy Policy [LINK]. The Services may contain third-party links. We are not responsible for third-party content, products, or services.

10. Prohibited Use

You may not use the Services in any way that violates laws or infringes third-party rights, transmits harmful code, abuses platform security, or interferes with others’ use of the Services.
We may suspend access or terminate accounts for violations.

11. Warranty Disclaimer

Except where required by law, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, WANNADO.ROCKS is not liable for any indirect, incidental, consequential, punitive or special damages, including loss of profits, data, reputation, or replacement costs.

13. Indemnification

You agree to indemnify and hold harmless WANNADO.ROCKS and its affiliates from claims or damages arising out of your breach of these Terms or your misuse of the Services.

14. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remainder shall continue in full effect.

15. TERMS FOR CUSTOMERS IN THE UNITED STATES OF AMERICA

For customers located in the United States, the following additional terms apply and shall prevail over conflicting provisions in these Terms:

15.1 Limitation of Liability & Exclusion of Damages

To the fullest extent permitted by applicable U.S. law, WANNADO.ROCKS shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, loss of data, loss of revenue, or replacement costs, regardless of the legal theory (including contract, tort, negligence, strict liability, or otherwise), even if advised of the possibility of such damages.

15.2 Warranty Disclaimer (U.S. Style)

The Services and all products are provided “AS IS” and “AS AVAILABLE”, without any warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15.3 Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute shall be resolved on an individual basis. Class actions, class arbitrations, and collective dispute procedures are expressly waived.

15.4 Export, Taxes & Import Duties

U.S. customers are solely responsible for all applicable import duties, customs charges, brokerage fees, sales tax, and compliance with U.S. import regulations.
WANNADO.ROCKS is not responsible for delays caused by customs authorities.

15.5 Governing Law & Jurisdiction - For Customers in the United States of America

These Terms are governed exclusively by the laws of the Federal Republic of Germany. All disputes shall be resolved exclusively before the courts in Berlin, Germany. U.S. customers irrevocably waive any objection based on inconvenient forum.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.

17. Changes to Terms

We may update or modify these Terms at any time. Changes become effective upon posting. Continued use of the Services constitutes acceptance of updated Terms.
